Time to Invoke the Fifth

Nothing is so characteristic of sham-liberal judges, sham-liberal politicians, and the sham-liberal press as their inconsis-tency. They are as little ashamed for adding to the US Constitution as they are for subtracting from it.

They beat themselves in the breast about "freedom of ex-pression," though the First Amendment guarantees the free-dom of religion, speech, press, assembly, and petition, but mentions nothing about a supposed "freedom of expression," which can be (and perhaps will be) twisted into expressing oneself by publicly urinating on Liberty Bell.

But things are quite different when an accused or congres-sional witness "takes" or "invokes" the Fifth Amendment. (Why does he have to invoke something that is valid all the time? Do I have to invoke the Declaration of Independence to engage in the pursuit of happiness?) This is invariably inter-preted to mean that he cannot be compelled to be a witness against himself, and that is¾as usual with sham-liberals¾ the truth, but not the whole truth. The Fifth Amendment is one that tells you what the government can't do to you, and since apart from the witness clause it is a well kept secret, here it is in full, with my emphasis added for the point most impor-tant to this newsletter.

No Person shall be held to answer for a capital or otherwise infamous crime, unless on a presentment or indictment of a Grand July, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger, nor shall any person be subject for the same offence to he twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law, nor shall private property be taken for public use, without just compensation.

The emphasized clause concerns the all important issue of property rights, fanatically opposed by all totalitarian ideologies. Even Islam, an early and primitive type of totalitarianism (to be "spread with fire and sword"), prohibits charging interest on money loans. But the totalitarians of this century left no doubt where they stood on the point. Gemeingut geht vor Eigengut, said the Nazis, common [public] property takes precedence over private property. Marx wanted to na-tionalize all capital¾industry, transportation, the land, the banks (and in another well kept secret of special interest to Marxist feminists, the Communist Manifesto also clearly im-plies nationalizing "the community of women"). The Greens' attitude to property rights has perhaps best been formulated by Ralph Nader ("The Profits in Pollution" The Progressive, April 1970): "The planet earth is a seamless structure with a thin slice of sustaining air, water, and soil . . . This thin slice belongs to all of us" [emphasis added~.

The US government often ignored the Fifth Amendment, but it was only with the advent of the Green ideology that the Judiciary, Legislative and Executive has been enthusiastically and co-equally dumping on it.

Property is what I can do with as I please if I do not infringe on the rights of others. As in all other cases in the transition from Brown to Red to Green the approach has become more subtle here. The Nazis more or less confiscated only non-German property. The Reds confiscated all productive and income-producing property. But the Greens do not con-fiscate: "It remains your private property, but you must not do anything with it."

Examples are the EPA's Wetlands regulations, the ap-plication of the Endangered Species Act to private forests (and in a fraudulent interpretation at that), and many more verdicts, laws and executive orders often mentioned in these pages. As for the sham-environmentalists not yet in govern-ment, they will not even let you buy your own, legally irradiated food at the supermarket.

Under the law as it now stands, the EPA can declare your front lawn as wetlands and forbid you to do anything at all with it. The reason why it does not do so is political inex-pediency and the fact that the Greens, though catered to by the government, are not yet (as we go to press) the govern-ment. Once they are the government, political expediency will not matter, for then everything will be dictated and coerced.

[Bush's ally Assad of Syria just won an election with no less than 99.14%, surpassing both the days of Dein Ja dem Fuhrer (your yes to the Leader) and the results of public voting under the eyes of the Communists.]

As health food specialist Sandy Shaw said, "Of course the US Constitution isn't perfect; but it is better than what we have now!"
